Please read these terms and conditions carefully before using the Designs by Naomi website or placing an order. By using our website or making a purchase, you agree to be bound by these terms.

1. General

Designs by Naomi is a sole trader business based in the United Kingdom, specialising in hand-painted bookmarks and custom artwork.

We reserve the right to update these terms at any time. Any changes will be posted on this page with an updated effective date. Your continued use of the website after changes are posted constitutes your acceptance of the revised terms.

2. Pricing and Payment

All prices are listed in pounds sterling (£) and include VAT where applicable. Shipping costs are displayed separately at checkout.

We accept payments via Stripe. Payment must be received in full before standard orders are dispatched. For custom orders, a non-refundable deposit is required before work begins, with the remaining balance due upon completion.

We reserve the right to change our prices at any time. Any price changes will not affect orders that have already been confirmed.

3. Standard Orders

Standard bookmarks are ready-made items available for immediate purchase. Orders are typically dispatched within 1–3 business days.

As each bookmark is hand-painted, slight variations in colour and detail are natural and part of what makes each piece unique. Product photographs are as accurate as possible, but minor differences may occur due to screen settings.

4. Custom Orders

Custom bookmarks and artwork commissions follow a structured process:

  1. Enquiry: You submit your requirements and ideas via our custom order form or by contacting us directly.
  2. Quote and deposit: We provide a quote based on your requirements. A non-refundable deposit is required to secure your commission slot and begin work.
  3. Creation and revisions: Work begins on your piece. We will share progress updates and allow for reasonable revisions at agreed stages.
  4. Final payment and delivery: Once you are happy with the finished piece, the remaining balance is due. Your order is then packaged and dispatched.

Non-refundable deposits: Deposits for custom work are non-refundable once work has commenced. This covers the time, materials, and creative effort invested in your commission.

Approximate turnaround for custom orders is 3 weeks from deposit payment, though this may vary depending on complexity and revision requests.

5. Intellectual Property

All artwork, designs, photographs, and content on this website are the intellectual property of Naomi / Designs by Naomi unless otherwise stated.

When you purchase or commission a piece of artwork, you receive the physical item. Naomi retains all intellectual property rights, including the right to reproduce, photograph, or display the artwork for promotional and portfolio purposes.

You may not reproduce, distribute, or commercially use any artwork or content from this website without prior written permission.

6. Limitation of Liability

Designs by Naomi shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or products, to the fullest extent permitted by law.

Our total liability in respect of any claim shall not exceed the amount paid by you for the relevant product or service. Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

7. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of our website shall be subject to the exclusive jurisdiction of the courts of England and Wales.
